Let an experienced lawyer help you pursue compensation for your injuries
If you are injured or lose a loved one in a wrongful death and you hire an attorney, your lawyer will help you pursue “damages” for your losses. Damages is a term that refers to money awarded by a court to an individual who has been injured through the wrongful conduct of another party.
An experienced attorney can examine the circumstances of your injury and determine which types of damages to pursue. After an injury, your medical bills can accumulate quickly. You may have to miss work, leading to a loss of income. A knowledgeable lawyer will be able to assess your losses, which also may include non-economic damages such as pain and suffering or emotional distress, and demand compensation from the responsible party.
The following are the different types of damages in personal injury cases:
Compensatory Damages are for expenses related to your injury. The two types of compensatory damages are actual damages and general damages. It does not cover emotional damages or punitive damages.
Actual damages reimburse victims for out-of-pocket expenses. This includes items someone injured paid money for because of the injury, including, but not limited to, replacement of property, medical bills, lost wages and rehabilitation.
General damages reimburse victims for non-monetary items. For example:
– Loss of consortium (harm to the victim’s marriage)
– Emotional suffering
– Pain and suffering
– Inability to enjoy life
A third type, punitive damages, is meant to punish the defendant (the party that has caused harm). Courts may order the defendant to pay the plaintiff (the party that has been harmed and has filed a lawsuit) punitive damages if he or she is found to have acted intentionally or maliciously. For example, someone who assaults another person and disables that person may be ordered to pay punitive damages.
